Imposter X: Party Game ("Imposter X," the "App") is a local, pass-the-phone social-deduction party game published by Cuberix ("Cuberix," "we," "us"). By downloading or playing Imposter X you agree to these Terms of Service. If you do not agree, please stop using the App.
We may update these terms as the game evolves. When we make material changes we will update the "Last updated" date above; continuing to use the App after a change means you accept the updated terms.
Imposter X is a social party game intended for fun among friends. You agree to use it lawfully and not to misuse, reverse engineer, decompile, or disrupt the App or other players' enjoyment of it.
The App is designed for local play: players pass one device around the table. Player names and game settings you enter are stored on your device and are your responsibility. Some word packs are marked for adult groups (18+); you are responsible for choosing content appropriate for the people you play with.
Imposter X offers an optional Pro subscription that unlocks premium content and removes ads. Subscriptions are billed through your Apple App Store or Google Play account, auto-renew until cancelled, and can be managed or cancelled at any time in your store account settings. Cancelling stops the next renewal; it does not refund the current period.
Purchases are final except where a refund is required by the platform (Apple or Google) or by applicable law. Refund requests are handled by the store you purchased through.
Word packs and game content are provided as-is for entertainment. Custom packs you create, and names you enter for players, are stored locally on your device; you are responsible for that content and for sharing your device with other players.
The App, including its artwork, characters (including Detective Mia), word packs, and software, is owned by Cuberix or its licensors and is protected by copyright and other laws. We grant you a personal, non-exclusive, non-transferable licence to use the App for private entertainment. You may not copy, sell, or redistribute the App or its content.
The App is provided "as is" and "as available," without warranties of any kind, express or implied. To the maximum extent permitted by law, Cuberix is not liable for any indirect, incidental, special, or consequential damages arising from your use of (or inability to use) the App. Nothing in these terms excludes liability that cannot be excluded under applicable law, and nothing affects your statutory rights as a consumer.
You can stop using the App at any time by deleting it. We may suspend or discontinue the App (or any part of it) with reasonable notice where practicable. Paid entitlements remain governed by the store's refund rules.
These terms are governed by the laws applicable in the publisher's place of business, without prejudice to any mandatory consumer-protection rules of the country you live in.
This section applies when you obtain Imposter X from the Apple App Store. It contains the minimum terms Apple requires in a developer’s end-user licence agreement, and it prevails over anything above that conflicts with it.
These Terms are concluded between you and Cuberix only, and not with Apple Inc. Cuberix, not Apple, is solely responsible for the App and its content. These Terms may not provide for usage rules for the App that conflict with the Apple Media Services Terms and Conditions.
The licence granted to you for the App is a non-transferable licence to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
Cuberix is solely responsible for providing any maintenance and support services for the App, as specified in these Terms or as required by applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services for the App.
Cuberix is solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Cuberix’s sole responsibility.
Cuberix, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the App’s use of the HealthKit and HomeKit frameworks (which the App does not use).
In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, Cuberix, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such intellectual property infringement claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms of agreement when using the App.
You and Cuberix acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary of them.
